This End-User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("End-User" or "you") and jscriptz ("Developer," "we," "us," or "our") for the use of the Acrophobia mobile application (Bundle ID: com.jscriptz.acrophobia) (the "Licensed Application" or "App").
By downloading, installing, or using Acrophobia, you agree to be bound by this Agreement. If you do not agree, do not use the App.
You and the Developer acknowledge that this EULA is concluded between you and jscriptz only, and not with Apple, Inc. ("Apple"). jscriptz, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA does not provide for usage rules that conflict with the Apple Media Services Terms and Conditions as of the date of acceptance.
The Developer grants you a limited, non-transferable license to use the Licensed Application on any Apple-branded Products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
Acrophobia is a real-time multiplayer word game where players create phrases from random letter acronyms. The App includes AI-powered bot players, real-time multiplayer, leaderboards, social features, in-game chat, and optional in-app purchases.
You may create an account using anonymous sign-in, Google Sign-In, or Apple Sign-In. You are responsible for maintaining the security of your account. You agree not to impersonate others or create accounts for the purpose of harassment.

Acrophobia offers optional in-app purchases including virtual gems, avatar packs, and auto-renewable subscriptions ("AI Pro"). All purchases are processed through Apple's App Store or Google Play.
Subscriptions:
Virtual Currency (Gems): Gems are virtual items with no real-world value. Gems cannot be transferred, sold, or exchanged for real currency. Unused gems are not refundable.
Acrophobia uses artificial intelligence (via the Anthropic Claude API) for bot players, answer suggestions, and translations. AI-generated content may not always be accurate or appropriate. We are not responsible for AI-generated content.
jscriptz is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA or as required under applicable law. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
jscriptz is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be jscriptz's sole responsibility.
You acknowledge that jscriptz, not Apple, is responsible for addressing any claims you or any third party may have relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to:
This EULA does not limit jscriptz's liability to you beyond what is permitted by applicable law.
All content, design, and code in Acrophobia is owned by jscriptz. User-generated content (game answers, messages) remains the property of the respective users, but you grant us a license to display it within the App.
You acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party's intellectual property rights, jscriptz, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
You represent and warrant that:
You must comply with applicable third-party terms of agreement when using the App. For example, you must not be in violation of your wireless data service agreement when using the App.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
To the maximum extent permitted by law, jscriptz shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.
We may update this EULA from time to time. Continued use of the App after changes constitutes acceptance of the updated terms. We will update the "Last Updated" date at the top of this page when changes are made.
